Colorum is a common Filipino slang term used to describe an individual who is operating a service or practicing a profession without the required legal license, registration, or authority from the government. In real estate, a “colorum” agent is someone who illegally facilitates property transactions without being a licensed Real Estate Broker or a PRC-accredited Real Estate Salesperson.


What is a “Colorum” Agent in Real Estate?

A colorum agent is an unauthorized and illegal practitioner in the real estate service. They may present themselves as a legitimate agent, but they have not met the legal requirements set by the Real Estate Service Act (RESA Law).

These individuals can be anyone: a person acting as an informal “referrer,” a former agent whose accreditation has expired, or someone who simply wants to earn a commission without undergoing the mandatory training and registration. While some may have practical experience, their lack of a license or accreditation means they are operating outside the law and without any professional accountability.


Why is Dealing with a Colorum Agent Dangerous?

Transacting with a colorum agent puts your entire homebuying investment at extreme risk. Here are the primary dangers:

  1. No Accountability: A colorum agent is not regulated by the PRC and is not bound by the professional Code of Ethics. If they misrepresent a property, give you wrong legal or financial advice, or disappear with your money, you have very little recourse. There is no license to revoke and no professional body to hold them accountable.
  2. High Risk of Scams: This is the most significant danger. Colorum agents may ask you to pay reservation fees or downpayments to their personal bank or GCash account instead of the developer’s official account. Once the money is sent, they can disappear without a trace, and you will have lost your hard-earned savings.
  3. Lack of Expertise: Legitimate professionals undergo mandatory training on the complex legal, financial, and technical aspects of a real estate transaction. A colorum agent often lacks this knowledge, which can lead to them giving you incorrect advice that could cause you to make costly mistakes.
  4. Potentially Invalid Transactions: The RESA Law prohibits developers and brokers from paying a commission to an unlicensed individual. A deal facilitated by a colorum agent can face legal challenges, delays, or even be invalidated.

How to Spot and Avoid a Colorum Agent

Protecting yourself is simple if you know what to look for. These are the biggest red flags:

  • They Cannot Present a PRC ID: This is the number one sign. A licensed broker has a PRC License ID. An accredited salesperson has a PRC Accreditation ID. If they cannot show you this physical, government-issued card, stop the transaction immediately.
  • They Ask for Payments to a Personal Account: All official payments (reservation fees, downpayments) must be made directly to the developer’s or the property owner’s official company bank accounts. Never pay into an agent’s personal account.
  • They are Vague About Their Supervising Broker: A legitimate salesperson is always proud to be part of a professional team and will readily tell you the name of their supervising broker. A colorum agent will be evasive about this.
  • They Offer “Too Good to Be True” Deals: They may promise you unofficial “discounts” by offering to give you a cut of their commission—a commission they are not legally entitled to in the first place.

The Real Estate Service Act (RESA Law) or R.A. 9646 was specifically enacted to combat the widespread problem of colorum agents, which was rampant for decades. The law’s purpose was to professionalize the industry and protect the Filipino public from scams and incompetence.
